1. About Be NutriSavvy
Be NutriSavvy explains which nutrients different parts of the body need and the best whole-food, plant-based (WFPB) foods to get them from. It offers nutrition calculators that estimate the nutrients in a portion of food for each member of a household, and practical ideas for parents and individuals who want to eat food that is healthier, delicious, and convenient.
The Services are run from the United States. They aren’t meant for use anywhere that would break local law or require us to register there. If you use them from another country, you do so on your own initiative and are responsible for following your local laws.
The Services aren’t designed to meet industry-specific rules such as HIPAA or FISMA. Don’t use them for anything those laws cover, or in a way that would violate the Gramm-Leach-Bliley Act (GLBA).
2. Health information, not medical advice
Our articles, food and nutrient pages, and nutrition calculators are for general education and information only. They are not medical, nutritional, or dietary advice for any individual, and they are not a substitute for advice, diagnosis, or treatment from a physician, registered dietitian, or other qualified health professional.
Please talk with your health care provider before you change your diet, take supplements, or start a new eating plan, especially if you are pregnant or breastfeeding, are planning meals for a baby or child, take medication, or have a medical condition, food allergy, or history of disordered eating. Don’t ignore professional advice or delay getting it because of something you read or calculated on the Services. If you think you have a medical emergency, call your doctor, 911, or your local emergency number right away.
Using the Services does not create a doctor–patient, dietitian–client, or any other health care relationship between you and us.
3. Nutrition calculators
Calculator results are estimates for general education. They are based on published reference values (such as the Dietary Reference Intakes), food composition data (such as USDA FoodData Central), typical portion sizes, and what you enter. Real nutrient content varies with the food, variety, growing conditions, preparation, and portion, and each person’s needs vary with health, activity, and other factors. Results may contain errors. Don’t use them to diagnose, treat, or manage any medical condition, or as the only basis for decisions about your own or your family’s diet.
What you enter in a calculator, such as age group, sex, or pregnancy status, stays in your browser and is not saved or sent to us. Our Privacy Policy explains more.
4. Who may use the Services
By using the Services, you promise that:
- you are at least 18, are not a minor where you live, and are legally able to agree to these Terms
- you will follow these Terms
- you won’t access the Services through a bot, script, or other automated means
- you won’t use the Services for anything illegal or unauthorized, or in a way that breaks any law or regulation
If information you give us is untrue, inaccurate, out of date, or incomplete, we may suspend or close your account and refuse any current or future use of the Services.
5. Member accounts
You can create a free member account to use member features such as My Family. To have an account, you must:
- be at least 18 years old
- give accurate information and keep it up to date
- keep your password confidential (you are responsible for activity in your account)
- use the account only for yourself: don’t share your login, and don’t sell or transfer your account
Children can’t have their own accounts. A parent or guardian may add them to My Family, as described in section 6. If you think someone has used your account without permission, tell us right away at admin@benutrisavvy.com.
Closing your account. You can close your account at any time with Delete my account and data on the Members page. This permanently deletes your account and everything saved in it. We may also suspend or close accounts as described in section 14, and member features may change over time as described in section 13.
6. My Family and your private member content
Your private content. The family details you save in My Family, and anything else you save privately in your account (“private member content”), belong to you and are visible only to you. We use them only to provide member features, as described in our Privacy Policy and Consumer Health Data Privacy Policy. Private member content is not a Contribution, and the license in section 9 does not apply to it.
Health details and family members. My Family can include health details such as pregnancy or breastfeeding status and food allergies. We save them only with your consent, and you can withdraw it at any time by deleting the details. Only add a person if you are their parent or guardian, or they have agreed.
Results are estimates. The nutrient needs and nutrition values shown for your saved family are general estimates, as described in sections 2 and 3. Allergy information is a convenience only: always read ingredient labels and follow your health care provider’s advice. My Family is not a medical record and does not create a health care relationship.
7. Our content and how you may use it
What we own. We own, or are licensed to use, everything that makes up the Services: the text, recipes, photos, graphics, audio, video, designs, software, source code, databases, and features (the “Content”), and the names, trademarks, and logos in them (the “Marks”). They are protected by copyright, trademark, and other intellectual property and unfair competition laws in the US and other countries. We provide the Content and Marks “as is.”
What you may do. As long as you follow these Terms, we give you a personal, non-exclusive, non-transferable license, which we can revoke, to:
- use the Services, and
- download or print a copy of Content you have legitimately accessed,
for your own personal, non-commercial use or your organization’s internal use.
What you need permission for. Apart from that, you may not copy, republish, post, display, translate, distribute, sell, license, or otherwise use any part of the Services, Content, or Marks for commercial purposes without our written permission. To ask, email admin@benutrisavvy.com. If we give permission, you must credit us as the owner or licensor and keep any copyright or ownership notice visible.
We keep all rights we don’t expressly give you. If you break this section, you are in material breach of these Terms and your right to use the Services ends immediately.
8. Things you agree not to do
Use the Services only for the purposes we offer them for, and not for any commercial venture we haven’t approved. In particular, you agree not to:
Take or copy what isn’t yours
- gather data or Content from the Services, by hand or automatically, to build a collection, database, or directory without our written permission
- use bots, spiders, scrapers, data-mining tools, offline readers, or other automated tools or unauthorized scripts on the Services (normal search engine and browser use is fine)
- copy or adapt the software behind the Services, including its PHP, HTML, JavaScript, or other code, or decompile, disassemble, or reverse engineer it, except where the law allows
- remove copyright or other ownership notices from any Content
- frame or link to the Services in ways we haven’t authorized
Interfere with the Services or their security
- get around, disable, or interfere with security features, including those that limit use or copying of Content or restrict access
- upload viruses or other harmful material, or spam, including repetitive posts and excessive capital letters
- upload anything that collects or sends information passively, such as tracking pixels, web bugs, cookies, or spyware
- disrupt the Services or the networks connected to them, or put an unreasonable load on them
Mislead, harass, or harm others
- trick, defraud, or mislead us or other users, especially to get passwords or other account information
- impersonate another person or use someone else’s username
- use information from the Services to harass, abuse, or harm anyone
- harass, intimidate, or threaten our staff or contractors
- misuse our support or make false reports of abuse or misconduct
- disparage or otherwise harm us or the Services, in our judgment
Misuse accounts or use the Services commercially
- collect users’ names or email addresses to send unsolicited email, or create accounts automatically or under false pretenses
- sell or transfer your profile
- use a buying or purchasing agent to make purchases on the Services
- advertise or sell goods or services through the Services, or use the Services or Content to compete with us or for any other money-making venture
Break the law
- use the Services in any way that violates applicable laws or regulations
9. Your messages, comments, and other contributions
Feedback and ideas you send us (“Submissions”). If you send us a question, comment, suggestion, idea, or other feedback about the Services, you transfer to us all intellectual property rights in it. We may use and share it for any lawful purpose, commercial or not, without crediting or paying you.
Content you post (“Contributions”). The Services may let you post or share comments, reviews, ratings, text, photos, video, audio, or other material, including in blogs, message boards, and forums. Contributions may be seen by other users and through other websites, so treat them as public and non-confidential. A Submission that is posted publicly is also a Contribution. Private member content, such as My Family, is not a Contribution (see section 6).
You keep ownership, and give us a license. You still own your Contributions. By posting one, you give us a worldwide, perpetual, irrevocable, non-exclusive, transferable, royalty-free, fully paid license, with the right to sublicense, to host, store, copy, publish, display, perform, distribute, translate, reformat, retitle, excerpt, adapt, sell, and otherwise use it, and to make new works from it, for any purpose (including commercial and promotional purposes), in any media now known or later developed. The license includes your name, image, and voice, and any names, trademarks, logos, and images you provide with it. You waive any moral rights in your Contributions, to the extent the law allows.
Your promises about what you send or post. For every Submission and Contribution, you promise that:
- it is your original work, or you have all the rights, licenses, and permissions needed to post it and grant us the rights above
- you have the permission of every identifiable person in it to use their name or likeness
- it doesn’t infringe anyone’s copyright, trademark, patent, trade secret, moral, privacy, or publicity rights
- it isn’t confidential
- it isn’t false, inaccurate, or misleading
- it isn’t spam, unsolicited advertising, a chain letter, a pyramid scheme, or another kind of solicitation
- it isn’t illegal, obscene, sexually explicit, violent, defamatory, hateful, harassing, threatening, bullying, abusive, or otherwise objectionable in our judgment, and doesn’t mock or demean anyone
- it doesn’t attack anyone because of race, national origin, gender, sexual orientation, or disability
- it doesn’t violate any law protecting children, or link to material that breaks these Terms or the law
You are solely responsible for your Submissions and Contributions. We aren’t responsible for statements in them, you agree not to take legal action against us over them, and you will reimburse us for any loss we suffer because you broke these promises, someone else’s intellectual property rights, or the law.
We can edit or remove Contributions. We don’t have to monitor Contributions, but we may edit, move, screen, or delete any of them at any time, for any reason and without notice, and we may suspend or close the account of anyone who breaks these Terms and report them to the authorities.
10. Links and third-party content
The Services may link to other websites or show articles, images, apps, software, or other material from third parties. We don’t check them for accuracy, suitability, or completeness and aren’t responsible for them or for their opinions, privacy practices, or policies. A link isn’t an endorsement. When you leave the Services, these Terms no longer apply, so read the terms and privacy policies of any site you visit or app you use.
Purchases you make on other websites are solely between you and the other company. We don’t endorse their products or services and aren’t responsible for those purchases. You agree not to hold us responsible for any loss or harm related to third-party websites or content.
11. Privacy and cookies
Our Privacy Policy and our Consumer Health Data Privacy Policy explain how we handle personal information and health data, and they are part of these Terms. You can change your cookie choices any time with the “Cookie preferences” link at the bottom of every page.
The Services are hosted in the United States. If you use them from a region whose data protection laws differ from US law, you agree that your information will be transferred to and processed in the United States.
12. Copyright complaints (DMCA)
We respect other people’s intellectual property. If you believe material on or linked from the Services infringes a copyright you own or control, please send our Copyright Agent a written notice. We will send a copy to the person who posted the material. Under federal law, you may be liable for damages if your notice materially misrepresents the facts, so if you aren’t sure the material infringes, consider talking to a lawyer first.
What your notice must include (as required by 17 U.S.C. § 512(c)(3)):
- the physical or electronic signature of someone authorized to act for the copyright owner
- the copyrighted work you say is infringed (or, for several works, a representative list)
- the material you say is infringing, with enough information for us to find it
- your contact information: address, phone number, and email if available
- a statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent, or the law
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner
If your material was removed by mistake, you can send our Copyright Agent a counter notice that includes:
- what was removed and where it appeared
- a statement that you consent to the jurisdiction of the federal district court for your address or, if you are outside the US, any judicial district where we are located
- a statement that you will accept service of process from the person who filed the original notice or their agent
- your name, address, and phone number
- a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification
- your physical or electronic signature
If we receive a valid counter notice, we will restore the material unless the person who filed the original notice tells us they have gone to court to stop the alleged infringement. A false counter notice is perjury and may make you liable for damages, costs, and attorney’s fees.

13. Running the Services: changes, availability, and corrections
Managing the Services. We may, but don’t have to: monitor the Services for breaches of these Terms; take legal action against anyone who breaks the law or these Terms, including reporting them to law enforcement; refuse, limit, or disable any of your Contributions; remove files or content that are too large or burden our systems; and otherwise manage the Services to protect our rights and property and keep them working properly.
Changes and availability. We may change, update, suspend, or remove any part of the Services at any time, for any reason, without notice, but we don’t have to keep information up to date. We can’t promise the Services will always be available: hardware, software, or other problems and maintenance can cause interruptions, delays, or errors. We aren’t liable for any loss, damage, or inconvenience from changes, price changes, downtime, suspension, or discontinuance, and nothing in these Terms obliges us to maintain or support the Services or release corrections or updates.
Corrections. Information on the Services, including nutrient values, descriptions, prices, and availability, may contain typos, inaccuracies, or omissions. We may correct, change, or update it at any time without notice.
14. Suspension and termination
These Terms apply for as long as you use the Services. WE MAY, AT OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ANYONE ACCESS TO THE SERVICES (INCLUDING BY BLOCKING IP ADDRESSES) FOR ANY REASON OR NO REASON, INCLUDING A BREACH OF THESE TERMS OR OF ANY LAW. WE MAY END YOUR USE OF THE SERVICES OR DELETE ANYTHING YOU HAVE POSTED AT ANY TIME, WITHOUT WARNING. These rights are in addition to every other right we have under these Terms.
If we suspend or close your account, you may not create a new one under your own name, a false or borrowed name, or another person’s name, even if acting for them. We may also take legal action, including seeking civil, criminal, and injunctive remedies.
15. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOU USE THEM AT YOUR OWN RISK. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DON’T PROMISE THAT THE CONTENT OF THE SERVICES, INCLUDING NUTRIENT VALUES AND CALCULATOR RESULTS, OR OF ANY LINKED WEBSITE OR APP, IS ACCURATE OR COMPLETE. WE ARE NOT RESPONSIBLE FOR:
- ERRORS, MISTAKES, OR INACCURACIES IN CONTENT;
- PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE SERVICES;
- UNAUTHORIZED ACCESS TO OUR SERVERS OR TO ANY PERSONAL OR FINANCIAL INFORMATION STORED ON THEM;
- INTERRUPTIONS OR STOPPAGES OF THE SERVICES;
- BUGS, VIRUSES, OR SIMILAR HARMFUL CODE THAT ANYONE TRANSMITS THROUGH THE SERVICES;
- ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE FROM USING CONTENT MADE AVAILABLE THROUGH THE SERVICES; OR
- DECISIONS OR ACTIONS YOU TAKE BASED ON OUR CONTENT OR CALCULATOR RESULTS.
WE DON’T GUARANTEE, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY PRODUCT OR SERVICE OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR A LINKED WEBSITE, AND WE ARE NOT A PARTY TO, OR RESPONSIBLE FOR MONITORING, ANY TRANSACTION BETWEEN YOU AND A THIRD PARTY. USE YOUR BEST JUDGMENT AND TAKE CARE WHEN BUYING ANYTHING, AS YOU WOULD ANYWHERE ELSE.
16. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER WE NOR OUR DIRECTORS, EMPLOYEES, OR AGENTS WILL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
WHATEVER THE CAUSE AND WHATEVER THE FORM OF ACTION, OUR TOTAL LIABILITY TO YOU WILL NEVER BE MORE THAN THE LESSER OF (A) WHAT YOU PAID US, IF ANYTHING, IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE, OR (B) $50.00 USD.
SOME US STATE AND INTERNATIONAL LAWS DON’T ALLOW LIMITS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THOSE LAWS APPLY TO YOU, SOME OR ALL OF THESE DISCLAIMERS AND LIMITS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
17. Your responsibility for claims (indemnity)
You agree to defend us and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, and to pay for any loss, damage, liability, claim, or demand by a third party, including reasonable attorneys’ fees and costs, that arises from:
- your Contributions;
- your use of the Services;
- your breach of these Terms;
- your breach of any promise you make in these Terms;
- your violation of anyone else’s rights, including intellectual property rights; or
- any clearly harmful act by you toward another user you connected with through the Services.
We may, at your expense, take over the defense and control of any such matter, and you agree to cooperate with us at your expense. We will make reasonable efforts to tell you about any such claim once we learn of it.
18. Data you send us
We keep some data you send through the Services, and data about how you use them, to manage how the Services perform. We back up data regularly, but you are solely responsible for the data you send and for activity under your use of the Services. We aren’t liable for any loss or corruption of that data, and you give up any claim against us for it.
19. Electronic communications and signatures
When you visit the Services, email us, or fill in online forms, you are communicating with us electronically. You agree to receive communications from us electronically, by email and on the Services, and that agreements, notices, disclosures, and other communications we send electronically meet any legal requirement to be in writing.
YOU CONSENT TO SIGNING, AGREEING, AND ORDERING ELECTRONICALLY, AND TO RECEIVING NOTICES, POLICIES, AND TRANSACTION RECORDS ELECTRONICALLY, FOR ANYTHING YOU OR WE DO THROUGH THE SERVICES. You waive any rights under laws in any jurisdiction that require an original signature, delivery or keeping of paper records, or payments or credits by means other than electronic ones.
20. Text messages
If you receive text messages from us, you can stop them any time by replying “STOP.” We may send one message confirming that you opted out. Your carrier’s message and data rates may apply, depending on your mobile plan. For help, email admin@benutrisavvy.com or call 818-253-4559.
21. Governing law and resolving disputes
Governing law. California law governs these Terms and your use of the Services, as it applies to agreements made and performed entirely in California, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act (UCITA) do not apply.
Talk to us first. If you or we have a dispute, claim, or controversy related to these Terms (a “Dispute”), we each agree to try to resolve it informally for at least thirty (30) days before starting arbitration. That period starts when one side sends the other written notice.
Binding arbitration. If informal talks don’t resolve a Dispute, it will be decided finally and only by binding arbitration, except for the Disputes listed under “Exceptions” below. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.
- The arbitration will follow the Commercial Arbitration Rules of the American Arbitration Association (AAA) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (the “AAA Consumer Rules”).
- Your filing fees and share of the arbitrator’s pay are governed, and where appropriate limited, by the AAA Consumer Rules. If the arbitrator finds these costs excessive, we will pay all arbitration fees and expenses.
- The arbitration may be held in person, by documents, by phone, or online, and will take place in Los Angeles, California unless the AAA rules or the law require otherwise.
- The arbitrator must follow the law and will decide in writing, giving reasons only if either side asks. An award can be challenged if the arbitrator fails to follow the law.
- Either side may go to court to compel arbitration, pause proceedings while arbitration is pending, or confirm, change, set aside, or enter judgment on an award.
Individual claims only. To the full extent the law allows, a Dispute may be arbitrated only between you and us individually. It can’t be joined with any other proceeding, arbitrated as a class action or using class action procedures, or brought on behalf of the general public or anyone else.
Exceptions. Informal negotiation and arbitration don’t apply to: (a) Disputes to enforce or protect, or about the validity of, either side’s intellectual property rights; (b) Disputes about theft, piracy, invasion of privacy, or unauthorized use; and (c) claims for injunctive relief.
Court. Any Dispute that goes to court instead of arbitration must be brought in the state or federal courts in Los Angeles, California. You and we consent to those courts’ jurisdiction and give up any objection based on personal jurisdiction or inconvenient forum.
Time limit. Any Dispute related to the Services must be started within one (1) year after it arose.
If part of this section is unenforceable. If any part of this section is found illegal or unenforceable, neither side will choose arbitration for the Disputes that part covers. Those Disputes will be decided by a competent court in Los Angeles, California, and both sides agree to that court’s personal jurisdiction.
22. Changes to these Terms
We may change these Terms at any time, at our sole discretion. When we do, we will update the effective date at the top, and you agree that this is enough notice of each change. Please check these Terms from time to time. If you keep using the Services after a change is posted, you accept the updated Terms.
23. Notice for California users
If a complaint with us isn’t resolved to your satisfaction, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.
24. General terms
- Entire agreement. These Terms, together with any policies or rules we post on the Services, are the entire agreement between you and us about the Services.
- No waiver. If we don’t enforce a right or provision, we haven’t given it up.
- Severability. If any provision, or part of one, is found unlawful, void, or unenforceable, it is separated from the rest, and the remaining provisions still apply in full. These Terms apply to the fullest extent the law allows.
- Assignment. We may transfer any or all of our rights and obligations to others at any time.
- Events outside our control. We aren’t responsible for loss, damage, delay, or failure to act caused by anything beyond our reasonable control.
- Relationship. These Terms and your use of the Services don’t create a partnership, joint venture, employment, or agency relationship between you and us.
- Interpretation. These Terms won’t be interpreted against us because we wrote them.
- Electronic form. You give up any defense based on these Terms being in electronic form or not being signed.
